WYOCAP acts as a brokerage facilitating connections between businesses and funding providers. Please be advised that submitting an application does not guarantee approval for funding. All offers are subject to final underwriting and verification by our lending partners. WYOCAP is not a lender and does not make final credit decisions.
3. User Responsibilities & Accuracy of Information
You are responsible for ensuring that all information provided during the application process is accurate, complete, and current. Providing false or misleading information may result in the immediate rejection of your application and potential legal consequences. You agree to notify us immediately of any changes to your business status or financial condition.
4. Offers, Rates & Changes
Factor rates, funding amounts, and terms provided in any quote are preliminary estimates. Final offers and rates may change based on a more detailed review of your business performance, credit history, and market conditions. WYOCAP reserves the right to modify or withdraw an offer at any time prior to the execution of a formal funding agreement.
5. Electronic Communications & E-Signatures
By using our services, you consent to receive communications from us electronically (via email, SMS, or site notifications). You agree that all agreements, disclosures, and documents provided electronically satisfy any legal requirement that such communications be in writing. We utilize electronic signature platforms, such as DocuSign, to execute funding agreements; your electronic signature carries the same legal weight as a handwritten signature.
6. Limitation of Liability
To the maximum extent permitted by law, WYOCAP shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use our services, or for any decisions made by third-party funding providers. We provide our platform on an 'as-is' and 'as-available' basis without warranties of any kind.
